Terms of Entry & Submission Agreement
1. Agreement
By submitting an entry to the BONJIL Muse Search, operated by BONJIL, LLC (“BONJIL”), you acknowledge that you have read, understand, and agree to these Terms of Entry & Submission Agreement, the BONJIL Muse Search Official Rules, and the BONJIL Muse Search Privacy Notice.
2. Eligibility
By submitting an entry, you represent that:
- You meet the eligibility requirements outlined in the Official Rules.
- The information you provide is accurate and complete.
- Your submission is made voluntarily.
3. Your Submission
A submission (“Archive Entry”) may include:
- A typed Note from a Muse
- A handwritten Note uploaded as an image
- Optional photographs
- Optional video
- Optional written reflections or supporting materials
Submission of optional materials is not required during the initial stage of the selection process.
Selected participants may be invited to provide additional materials in later stages.
4. Originality
By submitting an Archive Entry, you represent and warrant that:
- Your submission is your own original work.
- You own or otherwise have the legal right to submit all materials included in your entry.
- Your submission does not knowingly infringe upon the copyright, trademark, privacy, publicity, or other legal rights of any third party.
- All information provided is truthful and accurate.
5. Third-Party Content
If your submission includes photographs, videos, artwork, or other materials containing another person or third-party content, you represent that you have obtained any necessary permissions required for submission.
BONJIL reserves the right to reject submissions that may infringe upon the rights of others.
6. Content Standards
Archive Entries may not contain material that is:
- Unlawful
- Fraudulent
- Offensive
- Defamatory
- Harassing
- Discriminatory
- Obscene
- Sexually explicit
- Violent
- Threatening
- Misleading
- Infringing upon another person’s rights
BONJIL reserves the right to remove or disqualify any submission that does not meet these standards.
7. Submission Review
Submission of an Archive Entry does not guarantee:
- Publication
- Selection as a finalist
- Selection as the BONJIL Muse
- Inclusion within the Archives of New York
All submissions will be reviewed according to the Official Rules.
BONJIL reserves the right to accept, reject, or remove any submission at its sole discretion.
8. License & Use of Submitted Content
Participants retain ownership of their original submissions.
By submitting an entry, Participant grants BONJIL a worldwide, royalty-free, non-exclusive license to use, reproduce, publish, display, distribute, edit, adapt, excerpt, format, and otherwise use the Participant’s submitted Note, handwriting, story, photograph, video, audio, and other submitted materials in connection with the BONJIL Muse Search, Archives of New York, and BONJIL’s related editorial, marketing, advertising, promotional, public relations, archival, and communications activities.
This includes use across BONJIL’s websites, social media, digital advertising, print advertising, out-of-home advertising, retail environments, events, exhibitions, email, press and media outreach, television and broadcast media, third-party editorial or media coverage, campaign materials, and future Archives of New York editorial publications or collections, including a potential printed book.
Participant also grants BONJIL permission to identify Participant by first name and age in connection with the authorized use of their submission.
BONJIL may edit, crop, resize, format, excerpt, caption, or otherwise adapt submitted materials for editorial, creative, technical, or production purposes, provided that BONJIL does not knowingly materially alter the Participant’s submission in a manner intended to falsely represent the Participant.
No additional compensation will be owed for BONJIL’s authorized use of submitted materials unless otherwise expressly agreed in writing.
9. Additional Agreements
Participants selected to continue through later stages of the BONJIL Muse Search may be required to execute additional agreements, including but not limited to:
- Media & Publicity Release
- Talent Agreement
- Liability Release
- Additional photography or video consents
- Prize acceptance documentation
- Tax documentation
Failure to execute required agreements may result in disqualification.
10. Intellectual Property
Participants retain ownership of their original submissions.
The rights granted to BONJIL to use submitted materials are set forth in Section 8 of these Terms. Nothing in these Terms transfers ownership of a Participant’s original submission to BONJIL.
Finalists and the selected BONJIL Muse may be required to grant additional rights under separate Media/Publicity Release and Talent Agreements.
11. Privacy
Personal information submitted in connection with the BONJIL Muse Search will be collected, used, and maintained in accordance with the BONJIL Muse Search Privacy Notice.
12. No Purchase Necessary
No purchase is necessary to enter or be selected.
A purchase will not increase the likelihood of selection.
13. Taxes
Prize recipients may be responsible for applicable federal, state, provincial, local, or other taxes associated with any prize awarded.
Additional tax documentation may be required before prize fulfillment.
14. Right to Modify
BONJIL reserves the right to modify, suspend, postpone, or terminate the BONJIL Muse Search as provided in the Official Rules.
15. Acceptance
By submitting an Archive Entry, you acknowledge and agree that:
