Liability Release & Assumption of Risk

1. Parties

This Liability Release & Assumption of Risk (“Agreement”) is entered into between BONJIL, LLC (“BONJIL”) and the undersigned participant (“Participant”) in connection with Participant’s participation in activities related to the BONJIL Muse Search, including the Archives of New York campaign.

2. Covered Activities

Participant may voluntarily participate in one or more BONJIL Muse-related activities (“Activities”), which may include:

  • Visits to the BONJIL Madison Avenue Flagship
  • BONJIL skincare consultations and ritual experiences
  • Photography and video shoots
  • Interviews and content production
  • Editorial campaign production
  • Campaign events and celebrations
  • Public relations and media activities
  • In-store or off-site appearances
  • Experiential activations
  • Transportation or travel associated with campaign participation, where applicable
  • Other activities reasonably related to the BONJIL Muse Search

Specific Activities, dates, locations, and participation requirements may be communicated separately.

3. Voluntary Participation

Participant acknowledges that participation in the Activities is voluntary.

Participant may decline to participate in a particular Activity unless participation is expressly required as a condition of finalist or winner status under the BONJIL Muse Search Official Rules or another written agreement.

Participant agrees to follow reasonable instructions provided by BONJIL, event venues, production teams, photographers, videographers, skincare professionals, and other authorized personnel while participating in the Activities.

4. Assumption of Risk

Participant understands that participation in in-person events, photography or video production, travel, skincare experiences, and other Activities may involve ordinary and unforeseen risks.

Potential risks may include, without limitation:

  • Slips, trips, or falls
  • Minor physical injury
  • Fatigue or discomfort
  • Reactions or sensitivities associated with skincare products
  • Allergic reactions or skin irritation
  • Risks associated with travel or transportation
  • Risks associated with event venues or production locations
  • Risks arising from crowds or public events
  • Property loss or damage
  • Other risks reasonably associated with participation in the applicable Activity

Participant voluntarily assumes the risks associated with participation in the Activities to the extent permitted by applicable law.

5. Skincare & BONJIL Ritual Experiences

Participant understands that certain Activities may involve the application or use of BONJIL skincare products or participation in a BONJIL skincare ritual.

Participant agrees to disclose, to the extent reasonably necessary for safe participation, any known allergies, sensitivities, skin reactions, or other relevant information that could affect Participant’s ability to safely participate in a skincare experience.

Participant understands that:

  • Individual responses to skincare products may vary.
  • BONJIL cannot guarantee that a Participant will not experience sensitivity, irritation, or an allergic reaction.
  • Participant should promptly inform BONJIL personnel if discomfort or an unexpected reaction occurs during an experience.
  • Participant may request that use of a particular product be discontinued if Participant experiences discomfort or has concerns.

Nothing in this Agreement is intended to constitute medical advice or replace consultation with an appropriate healthcare professional.

Final health, allergy, product-use, and skincare waiver language to be reviewed by BONJIL Legal Counsel.

6. Photography, Video & Production Activities

Participant understands that campaign photography, video production, interviews, and related activities may involve:

  • Studio or location lighting
  • Production equipment
  • Extended periods of standing or sitting
  • Repeated photography or filming
  • Wardrobe, hair, makeup, or styling
  • Movement between locations
  • Reasonable direction from photographers, directors, stylists, or production personnel

Participant agrees to communicate any safety concerns or physical limitations that could affect safe participation.

Rights relating to the recording and use of Participant’s name, image, likeness, voice, story, and other Campaign Materials are addressed separately in the Media/Publicity Release & Talent Agreement.

7. Events & Public Appearances

Participant understands that certain Activities may take place at public or private events and may involve crowds, media, photographers, invited guests, creators, or other third parties.

Participant agrees to follow reasonable venue and event safety requirements.

Participant understands that BONJIL cannot control all actions of independent third parties present at public events.

8. Travel & Transportation

If travel or transportation is provided, arranged, reimbursed, or otherwise associated with Participant’s campaign participation, the specific terms will be communicated separately.

Unless expressly stated otherwise in writing, Participant is responsible for personal transportation and travel arrangements associated with participation.

Participant understands that travel and transportation involve risks outside BONJIL’s direct control, including delays, cancellations, accidents, lost property, and actions of independent transportation providers.

BONJIL Legal Counsel to determine appropriate allocation of travel and transportation risk based on the final prize and participation structure.

9. Personal Property

Participant is responsible for safeguarding personal belongings brought to campaign Activities.

To the extent permitted by applicable law, BONJIL is not responsible for loss, theft, or damage to Participant’s personal property except to the extent caused by conduct for which liability cannot legally be waived.

10. Participant Responsibility

Participant agrees to:

  • Exercise reasonable care while participating in Activities
  • Follow reasonable safety instructions
  • Promptly communicate known safety concerns
  • Refrain from participating in an Activity if Participant reasonably believes participation would be unsafe
  • Provide accurate information reasonably requested for safe participation
  • Notify appropriate BONJIL personnel of an injury, incident, or unexpected reaction occurring during an Activity

11. Release of Liability

To the fullest extent permitted by applicable law, Participant releases and agrees to hold harmless BONJIL and, as legally appropriate, its affiliates, officers, directors, employees, representatives, agencies, production companies, contractors, event partners, and other authorized parties (“Released Parties”) from claims arising out of or relating to Participant’s voluntary participation in the Activities, including claims arising from ordinary risks inherent in such Activities.

This release is not intended to waive any rights or claims that cannot legally be waived.

The scope of the Released Parties, covered claims, negligence standard, statutory limitations, and enforceability of this provision must be finalized by BONJIL Legal Counsel.

12. Medical Treatment in an Emergency

If Participant becomes ill or injured during an Activity and is unable to provide instructions, Participant authorizes BONJIL or its representatives to contact emergency medical services when reasonably necessary.

Participant understands that BONJIL does not undertake an obligation to provide medical care.

Responsibility for medical costs and any authorization relating to emergency treatment shall be determined in accordance with applicable law and the final language approved by BONJIL Legal Counsel.

13. No Medical Representation

Participant understands that BONJIL skincare products, rituals, experiences, and campaign activities are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Participant should consult an appropriate healthcare professional regarding medical concerns or questions about whether participation is appropriate for Participant.

14. Insurance

Participant understands that BONJIL does not provide personal health, medical, travel, or property insurance to Participant unless expressly stated otherwise in writing.

BONJIL Legal Counsel to determine whether any additional insurance disclosure is appropriate based on final campaign activities.

15. Relationship to Other Campaign Documents

This Agreement should be read together with, as applicable:

  • BONJIL Muse Search Official Rules
  • Terms of Entry & Submission Agreement
  • Privacy Notice
  • Media/Publicity Release & Talent Agreement
  • Prize Acceptance Documentation
  • Tax Documentation
  • Any event-specific or production-specific agreements

If there is a conflict among these documents, the final documents approved by BONJIL Legal Counsel will govern according to their terms.

16. Governing Law & Dispute Resolution

To be completed by BONJIL Legal Counsel.

17. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.

Final language subject to legal review.

18. Entire Agreement

This Agreement, together with any campaign documents expressly incorporated or applicable to Participant’s participation, constitutes the understanding between BONJIL and Participant regarding the risks and liability addressed herein.

Any amendment or waiver must be made in accordance with the final requirements established by BONJIL Legal Counsel.

PARTICIPANT ACKNOWLEDGMENT

By signing below, I acknowledge that:

  • I have read and understand this Agreement.
  • I understand that participation in the Activities is voluntary.
  • I understand that participation may involve certain risks.
  • I have had the opportunity to ask questions before participating.
  • I voluntarily assume the risks described in this Agreement to the extent permitted by law.
  • I agree to the release provisions above, subject to applicable law.
